The King County Prosecuting Attorney’s Office is considering amending a charge of first-degree attempted murder against Kareem Harris, 28.

Harris was charged Oct. 29, 2009, after he allegedly shot co-worker Wilbur Lee Gant several times on Oct. 28, 2009, outside Gant’s home in the 100 block of South 340th Street in Federal Way.

The two men formerly worked together at Milgard Windows in Fife until Harris was fired in May 2009 for timecard fraud, according to court records. A statement from Gant was later used in an unemployment hearing for Harris, according to court documents. The two men were involved in a dispute outside Gant’s home regarding the circumstances when Harris allegedly shot Gant.

Gant died Jan. 10 and the King County Medical Examiner’s Office is investigating whether his death was in direct relation to the shooting injuries he received 15 months ago.

“It’s rare that this happens, but we have dealt with it before,” said Ian Goodhew, a prosecuting office spokesman.

There is no statute of limitations on a homicide charge. The prosecuting attorney’s office plans to amend the charges, possibly as early as next week, if Gant’s death is found to have been caused by the shooting. The charge could range from manslaughter to murder, depending on the evidence presented, Goodhew said.

Harris last appeared in court on Dec. 17 and is currently scheduled for an omnibus hearing next month. Omnibus hearings are generally the last court appearances a suspect has before going to trial. Harris is scheduled for trial beginning March 24.

If charges against Harris are amended, the King County Prosecuting Attorney’s Office will ask for an arraignment for Harris at the February court hearing, Goodhew said. This could affect the date Harris goes to trial.
