A Federal Way man has been charged with first-degree rape of a child.

Miguel Angel Rodriguez Ayala, 28, is being held on a $150,000 bail at the Regional Justice Center in Kent.

King County prosecutors say Rodriguez Ayala sexually assaulted a 6-year-old girl between 12:30 a.m. and 2:30 a.m. on Sept. 29 in the 30200 block of 20th Avenue South.

According to the girl’s mother, she left her daughter and 2-year-old son with their grandfather, the mother’s father, that night as she went to the casino. Rodriguez Ayala got to the residence at 12:30 a.m. after getting off work. When the victim’s mother returned around 2:30 a.m., she noticed all the lights in the house were off when it was typical for her family to leave the lights on at night. Her 2-year-old son was also awake and watching TV by himself.

Rodriguez Ayala, who was upstairs, told the woman he was drunk and not feeling well, so he went to lie down with the victim who was sleeping downstairs.

The child’s mother went downstairs to check on her daughter and found her awake. The victim then told her Rodriguez Ayala had sexually assaulted her buttocks.

The mother immediately confronted the suspect, who told her the girl was lying. She took her daughter to St. Francis Hospital while Rodriguez Ayala accompanied her, and St. Francis Hospital Emergency Room staff called 911 to report the assault.

The girl spoke to police and gave a graphic account of what happened. Charging documents state officers described her as “articulate” and “adamant” about the details of the assault during a forensic child interview.

Officers also interviewed Rodriguez Ayala after his arrest at the hospital. He told officers the girl was lying and that the lights weren’t off at the house, and he had been watching TV with the 2-year-old in the living room when the girl’s mother returned.

During questioning, however, the suspect admitted to “sometimes” kissing the victim’s entire body, except her genitals and anus, when she’s clothed or nude. He also told police the girl occasionally “climbs all over him, he hugs her and his hands may ‘go crazy’ when he does.”

“Miguel denied any wrong doing and reported that to him ‘bad touch’ meant penile or digital penetration or touching someone’s private parts,” the charging documents state.

During the investigation, police were told the suspect spit out pieces of toilet paper during the assault. During a search of the house, police located two small tissue fragments. They also seized bedding and other tissue found in a trash can.

Written statements from the suspect’s brothers say Rodriguez Ayala was so intoxicated that he couldn’t be understood.

Child Protective Services took the victim and her brother into protective custody. Charging documents state the girl had a bruise on her forehead and smeared lipstick on her lips.

Rodriguez Ayala is barred from seeing or contacting the victim. His past criminal convictions include driving under the influence and reckless driving in 2009.
