Twin Lakes Homeowners Association work continues | Letter

In August 2016, the Twin Lakes Home Owner’s Association Board sanctioned the forming of a residents committee to draft a replacement covenants, conditions and restrictions document for the association. The current set of supplements has been in existence for 40 years, but like most things of significant age, the board recognized the need for a review with the possibility of a new single document.

A group of volunteer homeowner members began the process in September, and after several months of work, presented a preliminary draft to the association board with the expectation to receive feedback and be engaged in ongoing discussions. Instead, in November the board summarily dismissed the committee that it had sanctioned. The effect was no meaningful communication or substantive feedback to the committee from the board.

The work group then decided to continue the task without support by the board, including attempts to communicate with the homeowners’ board. The committee members concluded that the best option was to complete the drafting of a revised and reformatted document that was completed in August 2016.

An updated and concise covenants, conditions and restrictions having relevant, consistent, equitable stipulations via a reformatted document has been produced for the Twin Lakes community. That was the charter that was presented to the Covenants, Conditions and Restrictions Committee in September 2015 by the president of the Twin Lakes Home Owners Association and the task accepted and completed by voluntary members.

A completed draft document was provided to the association president in September 2016, and during the 2016 annual Twin Lakes Home Owners Association meeting, the committee made the following request to the board:

The draft document be shared (upon request) with any resident household that desired a copy.

As a follow-up measure, the committee members have requested that the following occur:

That the revision process be supported with engagement with discussions to refine a document that could be presented for a vote of acceptance by 75 percent of the property owners.

In response, the board indicated in a letter dated Oct. 31, 2016, that “the Board decided not to take any action to the group’s suggestions.” Copies of the draft document will not be provided to Association members.

The current refusal of the Twin Lakes Home Owners Association Board to support communications among the members has led to an alternative means to communicate to the association members.

A covenants, conditions and restrictions task force has been formed to ensure that association members are made aware of and have access to the revised covenants, conditions and restrictions draft document. If there is interest, briefings will be offered beginning in January 2017, with the follow-on intent to have the revision process be the subject at a special meeting called by the Home Owners Association Board.

Interested association members are encouraged to review this significant proposal and then render comments to the task force via the address provided above.
