King County prosecutors recently dismissed murder suspect Bernard Bellerouche’s case after attorneys determined they couldn’t prove beyond a reasonable doubt that Bellerouche was responsible for the May 2014 shootings that killed two Federal Way men.

Bellerouche was released from jail after being locked up for a year on unlawful possession of a firearm and first-degree murder charges.

King County Prosecutor’s Office spokesman Dan Donohoe said prosecuting attorneys believe this case warranted a dismissal because of some information that came to their attention after Bellerouche was charged.

“There’s still an ongoing investigation, so I think we’re going to hold off on elaborating at this time,” Donohoe said when asked what that information was.

With a $2 million bail because of Bellerouche’s criminal history, the then-28-year-old faced accusations that he shot and killed 27-year-old Demario Washington at the Silver Shadow Apartments in Federal Way on May 7, 2014. Federal Way police believed he was also connected to the death of 22-year-old George J. Gabriel, a Marine, on May 13, 2014. Gabriel was at the Mariposa Apartments in Federal Way at the time of the shooting and was transported to Harborview Medical Center, where he later died.

There was also speculation that Bellerouche was responsible for the shooting injuries of a 28-year-old Des Moines man on May 12, 2014.

Police identified Bellerouche after interviews with “numerous witnesses,” according to charging documents.

U.S. Marshals found Bellerouche in Kennewick on May 24, 2014, allegedly attempting to flee.

He pleaded not guilty to the charges on June 12, 2014 at the Norm Maleng Regional Justice Center in Kent.

Cathy Schrock, a spokeswoman with the Federal Way Police Department, said police department’s goal in every criminal case submitted to the prosecutor’s office is to have a successful prosecution.

She said the department submitted a “complete and thorough investigation” recommending the first-degree murder charge against Bellerouche but recognizes the “delicate balance between establishing probable cause” and the tremendous task of a successful prosecution.

“The Federal Way Police Department strongly believes Bernard Bellerouche committed this crime and the department will continue to work this case in an effort to identify additional witnesses to support the established facts,” Schrock said. “We encourage anyone that has information pertaining to this case contact Federal Way police.”

Because the investigation is ongoing, Schrock said the department will not elaborate on specific details of this case.
