Recall ruling appeal filed

The Des Moines Yes Recall Committee has formally appealed the ruling by King County Superior Court Judge Jim Doherty that rejected recall charges against four City Council members.

Ed Pina, the committee’s president, said an appeal was flied Oct. 9 by the group’s attorney, David Middleton, with the state Supreme Court. Pina said more documents will be filed Dec. 16, with a court date possible in January.

The recall committee contends Doherty made “significant legal errors” in ruling Sept. 25 that the charges didn’t warrant further recall proceedings.

The recall proponents claim council members Don Wasson, Richard Benjamin, Gary Peterson and Maggie Steenrod held illegal meetings and ordering official city action that would benefit them financially.

The committee need court permission before it can start collecting signatures of registered voters in Des Moines to force a recall election.
